What goals does the state set for itself?

Only citizens of the Russian Federation can apply for a subsidy. The state program applies to young people under the age of 35.

Action plan

Here is an algorithm of how potential applicants for a subsidy should act.

  1. Collect the above documents.
  2. Calculate your income. Only part of the money, about half, should go to repay the loan. The specialist will check that the family is not left without funds after committing to participate in the program.
  3. Write a statement to the local administration. Its essence lies in the fact that the family needs to improve their living conditions.
  4. Confirm the availability of the amount for the first installment.

  8. Take the above document to a banking institution (two months are given for this).

Achieved results

It is too early to say that the main goals of the Housing state program have been achieved. There was no decrease in the cost of apartments and houses, as well as the percentage of young families with satisfactory housing conditions.

Nevertheless, there are some successes. So:

  • the share of private housing of Russians is gradually increasing;
  • mortgage lending is developing;
  • the volume of the housing stock put into operation is growing;
  • the infrastructure of cities is being modernized through the use of funds from the budget and citizens.

The maximum amount of a concessional loan is 3 million rubles, and in the capital and St. Petersburg - 8 million rubles.

Social payments are provided to the owner of the SHS in a non-cash form by crediting funds from the federal budget to his bank account opened with a bank.

The owner of the certificate, within 3 months (for the "GA" series - 2 months) from the date of issuance of the GZhS, hands it over to the bank at the place of purchase of the dwelling (s) or at the place of residence to conclude a bank account agreement and open a bank account.

When opening a bank account, the bank checks the compliance of the data specified in the GHS with the data contained in the identity document of the owner of the certificate, as well as the timeliness of submission of the GHS to the bank, after which it concludes a bank account agreement with him and opens a bank account in his name.

If a discrepancy between the data specified in the GHS and the data contained in the submitted documents is revealed, as well as in the event of a 3-month period (for the GA series - 2 months) from the date of issue of the GHS, the bank returns the GHS to its owner.

The owner of the GZhS has the right to apply to the executive authority that issued the GZhS with an application to replace the certificate.

The bank account agreement stipulates the basic conditions for servicing a bank account, the procedure for the relationship between the bank and the owner of the GZhS.

The bank account agreement is concluded for the period remaining until the expiration of the GHS, and may be terminated during the term of the bank account agreement upon a written application from the account holder. In the event of early termination of the bank account agreement, if the funds for social payments were not credited to the specified account, the bank issues the account holder with a certificate of termination of the bank account agreement without transferring the funds for social payments.

GZhS, handed over by its owner to the bank, after the conclusion of the bank account agreement, is not returned to the owner of the certificate.

If a bank account agreement is concluded not at the place of purchase of residential premises (s) on the territory of a constituent entity of the Russian Federation specified in the certificate, but at the place of residence, the account holder must submit to the bank before purchasing the residential premises (s) the place of purchase of residential premises (s), a previously concluded bank account agreement and a copy of the GZhS certified in accordance with the procedure established by the bank. The bank enters into a new bank account agreement with the account holder. In this case, the validity period of the new bank account agreement is limited by the validity period of the previously concluded bank account agreement. In this case, no commission is charged for opening an account (see reefs).

The bank account agreement stipulates that, by agreement of the parties, the opening and maintenance of a bank account is carried out at the expense of the account holder (see Tariffs).

The account holder, within the validity period of the bank account agreement, has the right to purchase in the primary or secondary housing markets on the territory of the constituent entity of the Russian Federation specified in the GHS, from individuals and legal entities (one or more) residential premises (residential premises) that meet the requirements , established by Articles 15 and 16 of the Housing Code of the Russian Federation, improved in relation to the conditions of the settlement chosen for permanent residence, including in rural areas (taking into account outbuildings). At the same time, it is allowed to acquire a share in the common ownership of residential premises (s), provided that, as a result of such a transaction, the residential premises (s) are fully transferred to the common shared ownership of the account owner and his family members.

When specifying in the certificate in the column “name of the subject of the Russian Federation” the federal cities of Moscow, St. Petersburg or Sevastopol, it is allowed to purchase residential premises (s), respectively, in the Moscow region, the Leningrad region or the Republic of Crimea.

The owner of the account has the right to purchase residential premises (s) not only within the funds of social benefits, but also using his own and (or) borrowed (credit) funds, as well as funds (part of funds) of maternity (family) capital.

The account holder submits to the bank at the place of purchase of the dwelling (s) to pay for the purchased residential premises (s), documents for the payment of civil housing and at the same time draw up an application-order to write off social payments for the intended purpose when they are received on the account.

The originals of the sale and purchase agreement and statements (statements) are kept in the bank until funds are transferred to the person (s) specified in the sale and purchase agreement, or until a decision is made to refuse such a transfer, and then returned to the account holder.

The bank checks the package of documents for payment within 3 working days from the date of receipt. Based on the verification results:

When making a decision to accept a sale and purchase agreement for payment, it sends an application to the Federal State Institution “United Directorate” of the Ministry of Construction of Russia for the transfer of social benefits as payment for the sale and purchase agreement;

When deciding to refuse to accept the sale and purchase agreement for payment, the Bank notifies the account holder in writing, stating the reasons.

FKU "United Directorate" of the Ministry of Construction of Russia, within 5 working days from the date of receipt of the Bank's application, verifies the data specified in the application for compliance with the data contained in the unified register of issued certificates.

If they comply, the territorial body of the Federal Treasury is provided with payment documents for the implementation, in the prescribed manner, of the operation of transferring funds of social payments to the account of the owner of the GZhS, opened for him in the bank.

After the receipt of social payment funds to the account of the owner of the SHS, they are transferred for the intended purpose to the recipient.

Documents to be submitted to the bank for payment of residential premises (s):

  1. The contract (s) for the purchase and sale of residential premises (s), on the basis of which the state registration of ownership of the residential premises (residential premises) was carried out;
  2. Extract (extracts) from the Unified State Register of Real Estate;
  3. Credit agreement (loan agreement) on the provision of funds for the purchase of residential premises (residential premises) (if any);
  4. Bank account agreement;
  5. A document proving the identity of the owner of the GZhS or a trustee; a notarized power of attorney (or a power of attorney equated to a notarized one, if the documents are submitted to the bank by an authorized person).

Mandatory indication of the details in the purchase and sale agreement:

  1. The address of the acquired dwelling (s), the area of ​​the dwelling (s);
  2. The price of the living space (s) (in figures and words); if there is a surcharge, then the terms of payment of the missing amount and the terms of transfer of own or borrowed funds are prescribed;
  3. GZhS details: series, number, date of issue, name of the authority that issued the certificate;
  4. Account, full name of the owner of the GZhS, from which the funds of social payments are transferred;
  5. Account, full name of the seller, to which the funds of social payments are transferred.

IMPORTANT:

  1. The acquired living quarters (living quarters) are registered in the common ownership of all family members specified in the certificate.
  2. An extract from the Unified State Register of Real Estate (USRN) must contain complete data about each person for whom the right to housing is registered. An extract from the USRN is provided to the copyright holders themselves or their legal representatives, or to individuals and legal entities who have a power of attorney from the copyright holder or his legal representative. To obtain an extract from the USRN with the registration authority, containing complete data about each copyright holder, you must contact all copyright holders at the same time or their legal representatives, or persons who have a notarized power of attorney (s) from the copyright holder (s) or his (them) legal representative (s).
  3. When purchasing 2 or more residential premises, contracts for residential premises and extracts from the Unified State Register of Real Estate must be submitted to the bank at the same time.
  4. Residential premises (s) can only be purchased in the region indicated on the corresponding line in the certificate.
  5. It is allowed to accept the purchase and sale agreement for payment if the cost of the acquired residential premises (residential premises) is lower than the amount of social benefits specified in the certificate.

The first most urgent problem for a newly-made family is the lack of their own home. In some cases, the material base of the newlyweds allows them to acquire their own housing soon. The young family often receives housing from their parents. But most have to huddle in rented apartments until there is an opportunity to purchase something of their own. Therefore, the state is implementing a special targeted federal program "Housing", within the framework of which the subprogram "Provision of housing for young families" functions. The program started back in 2011. It is currently extended until 2020.

The legal framework of the program is the same for all regions of the country, its implementation differs slightly in different constituent entities of the Russian Federation. Since 2016, a new Resolution of the Government of Russia dated May 26, 2016 returns the right to a young family to use a special social payment to repay a previously taken mortgage loan. Until 2016, this was prohibited.

Goals of the Youth Subsidy Program

A young family can receive special subsidies under the program. Subsidies are targeted and can be implemented in such cases:

  1. To buy a house or apartment in the primary housing market or secondary. The acquisition of real estate in the secondary market is not realized in all constituent entities of the Russian Federation.
  2. To pay for the concluded contract for the construction of residential premises.
  3. To pay the first installment when giving the family a mortgage.
  4. To pay off the balance of the debt under an existing mortgage lending agreement or to pay the first installment under a housing cooperative agreement.

The property for which the young family can receive subsidies must be suitable for their permanent residence, and also be located in the region where the subsidy was issued. The total area of ​​housing being purchased or under construction should not be less than special norms per family member.

Conditions for obtaining a housing subsidy for a young family

The state implements a program to support a young family if a number of conditions are met:

  1. Both spouses are citizens of the Russian Federation.
  2. The family is officially registered as needing to improve their living conditions.
  3. Both spouses were under the age of 35 at the time of approval of the list for assistance.
  4. The family has children, and at least one parent is a citizen of the Russian Federation. Some regions consider it a prerequisite to have a child in the family.
  5. The total family income allows you to conclude a mortgage agreement at the bank. Or the family has funds that, together with the subsidy, will be enough to buy a home.

The right to subsidize the purchase of real estate from the state can only be used once.

How is the size of the subsidy for housing for a young family determined?

The amount of the subsidy is determined at the time of the final approval of the list of families to whom it will be provided. According to the program, families without children will receive 30% of the estimated cost of the acquired real estate. And families with children - 35%. If the purpose of using the subsidy is to pay off the balance of the contribution for a share in the housing cooperative or to pay the balance of the debt to the bank on a mortgage loan, then its size is limited to such amounts.

Subsidies are calculated based on the norm for the total area per family and the standard cost of 1 square meter. housing in this locality. When determining the standard, the average regional market value of housing is taken into account. This figure is approved quarterly by the Ministry of Construction of Russia with mandatory publication on the official website. The cost standard cannot exceed this indicator.

According to the standards, the norm of the total area for a family that has not yet had time to acquire children is 42 square meters. If there are three or more people in a family, then per family member there is a norm of 18 square meters. The total amount of the subsidy for a family without children (2 people) will not exceed 600 thousand rubles. A family of three can count on a maximum of 800 thousand rubles. If there are more than 4 people in the family, then the maximum subsidy will be 1 million rubles.

Young families with many children can count on specific benefits in addition to the program. They are different in each region. In some cases, a large family receives assistance from the state for 100% coverage of the costs of purchasing residential real estate.

How to get a subsidy?

If a young family meets the conditions described above, then they can count on state support when buying a home.

To get started, you need to consult your local department for housing policy, or the youth affairs committee. There you can check the list of documents for filing a request for assistance.

After submitting the application, the municipal authorities will include the family indicated in it in the list for receiving the subsidy, which will be formed for the next year. Applications are listed in order of priority. Families with three or more children are eligible to be included in the skip-the-line list.

Final lists are formed on the basis of the compiled lists and information from the constituent entity of the Russian Federation on the amount of funding. If the age of at least one family member at the time of approval of the lists has exceeded 35 years, then the family is excluded from the list.

Within 5-15 days after the final approval of the subsidy lists, the municipal authorities must notify the families that they are included in the program for receiving assistance for the next year, and issue them special certificates that are the basis for receiving subsidies. The family submits this document to the bank within a month in order to open an account for receiving targeted funds under the program.

Local housing programs for young families

In the constituent entities of the Russian Federation, there are also local programs that are aimed at helping young families to buy housing. To take advantage of regional social programs, you need to collect a package of documents and submit to municipal local authorities.

The applicant provides the following documents:

  • statement in the approved form;
  • copies of documents for each family member - passport, marriage certificate, birth certificate;
  • a document that confirms the need to purchase housing;
  • a document confirming the total family income or a bank statement confirming that the family has funds to buy a home in the event of a subsidy.

If a young family has already acquired housing through a mortgage loan, or built it, then you can receive compensation for the costs incurred. To do this, you will need to provide the following documents to the municipal authorities:

  • a copy of the certificate in confirmation of state registration or a construction contract, which is proof of the costs incurred for the construction of real estate;
  • certificate from the bank with information about the amount of debt on the mortgage loan.

The municipal authorities check the documents provided, and then within 10 days include the family in the assistance program. If the receipt of a subsidy is denied, then within five days they must notify the applicant about this and indicate the reason for the refusal.

Why they may refuse to receive a subsidy

Municipal authorities do not always make a positive decision on assisting young people in purchasing housing. Sometimes you can face rejection. There are a number of reasons for this:

  1. Does not meet age or citizenship requirements for the program.
  2. The package of documents is not complete.
  3. Subsidy application is resubmitted.

The main problem faced by newly minted young families is a huge queue. Inclusion in the program can never be expected, reaching the borderline 35 years. The problem of providing housing for the categories of citizens of the Russian Federation, to whom the state has obligations to provide housing in accordance with the legislation of the Russian Federation, remains one of the most acute social problems.

One of the most effective ways to provide housing for the categories of citizens to whom the state has obligations in accordance with the legislation of the Russian Federation is the mechanism for providing social payments from the federal budget for the purchase of housing through the issuance of state housing certificates.

Despite the results achieved, the insufficient level of housing provision for citizens and the low availability of housing remain one of the main socio-economic problems of the Russian Federation.

According to the Federal State Statistics Service, in 2013, 27 percent of Russian families noted that they feel cramped in housing conditions, and among families with children under the age of 18, 48 percent of families indicated this circumstance, 6 percent of citizens indicated bad or very bad the condition of the occupied housing, the total volume of dilapidated and emergency housing stock is about 94 million square meters. meters. According to the Federal State Statistics Service, in 2014 the average selling price of housing exceeded the average cost of its construction by 32 percent, and the growth rate of housing prices exceeded both the growth rate of prices for building materials and the growth rate of real disposable income of the population.

Despite the development of the market for residential mortgage lending, this instrument remains inaccessible for most citizens of the Russian Federation due to the significant amount of the initial payment in relation to the average income level, as well as due to the high level of interest rates on such loans, which at the beginning of 2015 was about 18 percent. on ruble loans.

It should be recognized that the transformation of housing relations towards the introduction of market principles of their organization did not have a positive impact on the solution of social problems of the long-term socio-economic development of the Russian Federation in the field of housing and the implementation of the constitutional right of citizens of the Russian Federation to housing.

Thus, the achievement of the strategic goal of ensuring the affordability of housing for all categories of citizens and the correspondence of the volume of comfortable housing stock to the needs of the population established by the Concept of long-term socio-economic development of the Russian Federation for the period up to 2020 is objectively impossible without the implementation of a set of measures of state housing policy aimed at providing social support to citizens, and to adjust the structure of the housing market and bring it in line with the needs of citizens of the Russian Federation and the goals of the long-term socio-economic policy of the state.

The implementation of the federal target program "Housing" for 2015 - 2020 (hereinafter referred to as the Program) will be carried out within the framework of the state program of the Russian Federation "Provision of affordable and comfortable housing and communal services to citizens of the Russian Federation" and will become one of the main structural elements of the state housing policy aimed to continue the implementation of measures to improve the situation in the housing sector.

The program includes activities in two areas:

provision of state support to citizens in need of better housing conditions, as part of measures to fulfill state obligations to provide housing for categories of citizens established by federal legislation, provide housing for young families and provide housing for certain categories of citizens on the basis of decisions of the President of the Russian Federation and decisions of the Government of the Russian Federation;

creating conditions for the development of the market for affordable and comfortable economy class housing, curbing the growth of housing prices, increasing the volume of housing commissioning and the development of the construction industry as part of measures to support programs for the development of housing construction in the constituent entities of the Russian Federation.

The need for an accelerated transition to sustainable functioning and development of the housing sector determines the advisability of using the program-targeted method to solve these problems, since they:

are reflected in the main directions of the Concept of long-term socio-economic development of the Russian Federation for the period up to 2020 and priorities for the formation of federal target programs, and their solution makes it possible to improve housing conditions and the quality of life of the population, to prevent emergencies associated with the functioning of life support systems and effective the functioning of the housing market;

cannot be resolved within one financial year and require significant budgetary expenditures up to and including 2020;

are complex in nature, and their solution will have a significant positive impact on social well-being in society, general economic development and production growth.

At the same time, the use of the program-target method in solving the tasks set by the Program is associated with certain risks. The main risks for the successful implementation of the Program activities and achievement of the set goals are:

a decrease in the volume of financing of the Program activities from the federal budget caused by an unfavorable situation in the economy of the Russian Federation or a change in the priorities of state policy;

inability of highly subsidized constituent entities of the Russian Federation to ensure the required level of co-financing of expenditure obligations for the Program activities;

a decrease in the volume of housing commissioning and an increase in the cost of construction under the influence of negative financial and economic changes in the housing market, as well as in the housing construction industry.

To select options for solving the identified problems in the field of providing citizens of the Russian Federation with affordable and comfortable housing, two scenarios for the formation and implementation of the Program were considered, which provide for different approaches to determining the composition of activities and financing parameters of the Program.

The first scenario (baseline) is based on the approaches tested in 2011 - 2014 within the framework of the federal target program "Housing" for 2011 - 2015, and presupposes the preservation of the main directions of its implementation with the optimization of the structure of events and determination of the amount of their financing, taking into account the restrictions established The federal law "On the federal budget for 2015 and for the planning period of 2016 and 2017", as well as the funding limits for the state program of the Russian Federation "Provision of affordable and comfortable housing and utilities for citizens of the Russian Federation."

The advantages of this scenario are the balance of budgetary expenditures and the achievement of the predicted results of the implementation of the Program, aimed at achieving the goals of the state housing policy.

The second (optimistic) scenario assumes a significant increase in the coverage of citizens with the Program's activities in order to provide maximum housing for citizens recognized as needing better housing conditions, and an intensive development of housing construction due to a significant increase in funding for the Program from the federal budget and the budgets of the constituent entities of the Russian Federation.

The advantage of this scenario is a radical improvement in the situation in the sphere of housing provision for citizens of the Russian Federation, a solution to the housing problem of the majority of citizens, and a significant improvement in the social and demographic situation. At the same time, the implementation of such a scenario will require an increase in funding for the Program from the federal budget by 3.4 times (by 874.93 billion rubles), which significantly exceeds the capabilities of the federal budget.

In this regard, the most optimal and realistic from the point of view of financial support is the first (baseline) scenario, which will ensure the achievement of the planned values ​​of the target indicators with the rational use of budget funds.

II. Goals and objectives, implementation timeframes and target indicators

and Program indicators

The goals and objectives of the Program are determined by long-term strategic goals and priority tasks of the state housing policy established by the Concept of long-term socio-economic development of the Russian Federation for the period up to 2020 and by the Decree of the President of the Russian Federation of May 7, 2012 N 600 "On measures to ensure the citizens of the Russian Federation affordable and comfortable housing and improving the quality of housing and communal services. "

The main long-term strategic goal of the state housing policy is to ensure the affordability of housing for all categories of citizens and the correspondence of the volume of comfortable housing stock to the needs of the population.

The main objectives of the Program are:

the formation of a market for affordable economy class housing that meets the requirements of energy efficiency and environmental friendliness;

The main objectives of the Program are:

creating conditions for the development of mass construction of economy class housing;

increasing the level of housing provision for the population by increasing the volume of housing construction;

provision of social support for the purchase of housing to citizens in need of better housing conditions, primarily young families.

To achieve the goals and solve the main tasks set in the Program, a set of regulatory, legal, organizational and financial measures will be implemented.

The priority areas of the Program are:

stimulating the development of housing construction;

support of effective demand for housing;

fulfillment of state obligations to provide housing for the categories of citizens established by federal legislation.

For each of the priority areas of the Program, the implementation of activities is envisaged, on the implementation of which the main financial and organizational efforts should be concentrated within the framework of the relevant subprograms that are part of the Program. General organizational measures are implemented within the Program as a whole.

To stimulate the development of housing construction as a priority, it is necessary to ensure the solution of the following tasks:

the formation of a segment of economy class housing that meets the requirements of energy efficiency, environmental friendliness and affordability, the development of low-rise housing construction and new forms of citizen participation in housing construction;

provision of land plots with engineering, social and road infrastructure;

state support for the introduction of new modern technologies and projects in the implementation of housing construction that meets the standards of economy class housing, including low-rise;

integrated development of territories for housing construction, creating conditions for attracting credit funds and private investment for these purposes.

To support the effective demand for housing, it is planned to implement measures to provide citizens with social benefits for the purchase (construction) of housing, including with the use of borrowed funds.

Fulfillment of state obligations to provide housing for the categories of citizens established by federal legislation will be carried out through the use of state housing certificates, as well as the provision of subventions from the federal budget to the budgets of the constituent entities of the Russian Federation for these purposes.

The main priority directions for the implementation of the Program and its subprograms, tasks and activities of the Program are subject to clarification annually based on the results of the implementation of the Program activities for the year, as well as in the event of the approval of new strategic priorities of the state housing policy.

The program is being implemented from 2015 to 2020. The conditions for the early termination of the implementation of the Program may be the achievement of the goals and fulfillment of the objectives of the Program and the change in the directions of the state housing policy.

The system of target indicators of the Program includes one comprehensive indicator - the total number of citizens provided with housing under the Program, as well as indicators for the areas of implementation. Target indicators and indicators of the Program are given in Appendix N 1.

III. Program activities

Organizational measures will be aimed at creating conditions for the implementation of the main activities of the Program, supporting the development of housing construction, introducing mechanisms for attracting credit and investment funds to provide land plots with engineering infrastructure for housing construction.

The dynamics of the distribution of state and municipal support over the years is based on the need to provide the maximum possible support for the increase in housing commissioning in the coming years, since the mechanisms for attracting funds from private lenders and investors in the construction of communal infrastructure have not yet been developed.

The subprogram "Stimulating programs for the development of housing construction in the constituent entities of the Russian Federation" will ensure the massive construction of economy-class housing that meets the standards of affordability, energy efficiency and environmental friendliness, and form a new segment of housing on the market.

Within the framework of this subprogram, measures will be implemented to provide subsidies to the budgets of the constituent entities of the Russian Federation for the implementation of programs for the development of housing construction in the constituent entities of the Russian Federation.

At the same time, it is planned that economy-class housing will be purchased by young families receiving state support within the framework of the subprogramme "Provision of housing for young families", citizens receiving state support under the subprogram "Fulfillment of state obligations to provide housing for categories of citizens established by federal legislation", and also by certain categories of citizens, the provision of housing for which is carried out within the framework of the Program activities.

Young families will be able to improve their living conditions within the framework of the Subprogramme "Provision of Housing for Young Families". The procedure for providing young families with social payments for the purchase of housing is established by the specified subprogram.

Organizational measures include the improvement of a unified system for the provision of social payments from the federal budget for the purchase of housing to categories of citizens established by federal legislation, using the mechanism for issuing state housing certificates.

Methodological and organizational assistance will be provided to recipients of state housing certificates in purchasing economy-class housing in the primary market.

Citizens - participants of the subprograms "Provision of housing for young families" and "Fulfillment of state obligations to provide housing for categories of citizens established by federal legislation" can apply to an authorized organization to provide services for the purchase of housing (residential premises) of economy class in the primary housing market.

The selection of authorized organizations will be carried out by the state customer of this subprogram, and information about these organizations will be communicated to the executive authorities involved in the implementation of the subprogram.

In order to implement a unified state policy in the acquisition of housing at the expense of budgetary funds, the mechanisms for coordinating state demand in the acquisition of residential premises will be improved.

The activities of the Program related to the provision of housing to the categories of citizens established by federal legislation will be implemented within the framework of the subprogram "Fulfillment of State Obligations to Provide Housing to Categories of Citizens Established by Federal Law."

The main mechanism for the implementation of the subprogram will be the provision of state housing certificates certifying the right of a citizen - a participant in the subprogram to receive social benefits from the federal budget for the purchase of housing.

Since 2015, the number of citizens participating in the subprogram "Fulfillment of state obligations to provide housing for categories of citizens established by federal legislation" will include citizens wishing to leave closed administrative-territorial formations and territories that were previously part of the boundaries of closed administrative-territorial formations with article 7 of the Law of the Russian Federation "On a closed administrative-territorial entity".

As part of the implementation of the subprogram "Provision of housing for certain categories of citizens", financing of the following activities is envisaged:

provision of housing for federal government civil servants in accordance with Article 53 of the Federal Law "On the State Civil Service of the Russian Federation";

provision of housing for prosecutors of the prosecutor's office in accordance with Article 44 of the Federal Law "On the Prosecutor's Office of the Russian Federation";

provision of housing for employees of the Investigative Committee of the Russian Federation in accordance with Article 35 of the Federal Law "On the Investigative Committee of the Russian Federation";

provision of housing for certain categories of citizens in accordance with clause 2 of the Regulations on the Administrative Department of the President of the Russian Federation, approved by the Decree of the President of the Russian Federation of September 17, 2008 N 1370 "On the Administrative Department of the President of the Russian Federation";

provision of housing for rescuers of rescue services and rescue teams of the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters, as well as families of those killed (deceased) in the line of duty of these categories of rescuers in accordance with Article 30 of the Federal Law " On emergency services and the status of rescuers ";

provision of social benefits to young scientists for the purchase of housing;

provision of housing for employees of scientific organizations through the construction of economy-class residential premises for the formation of a fund of specialized residential premises of the Federal Agency for Scientific Organizations and the provision of these premises to these employees, primarily young scientists.

Since 2015, within the framework of the subprogram "Provision of housing for certain categories of citizens", a program of assistance to certain categories of borrowers for mortgage loans (loans) who find themselves in a difficult financial situation will be implemented. For these purposes, in 2015, subsidies will be provided in the form of a property contribution to the authorized capital of the joint-stock company "Agency for Housing Mortgage Lending" in the amount of 4.5 billion rubles.

Within the framework of the subprogram "Modernization of municipal infrastructure facilities", it is envisaged to provide the constituent entities of the Russian Federation with subsidies from the federal budget to co-finance work on completion in 2015-2016 of the construction (reconstruction) of communal infrastructure facilities, work in respect of which was carried out within the framework of the federal target program "Housing" for 2011 - 2015.

It is recommended that the supreme executive bodies of state power of the constituent entities of the Russian Federation involve student teams in the implementation of activities co-financed under the Program.

The implementation of the Program is not associated with the risk of negative consequences. At the same time, when designing capital construction projects, financing (co-financing) of which is provided for under the Program, the requirements established by the Resolution of the Government of the Russian Federation of February 16, 2008 N 87 "On the composition of sections of project documentation and requirements for their content" will be observed, including compliance standards for the safety and reliability of buildings and structures, as well as environmental safety.

IV. Resource support of the Program

The total amount of funding for the Program in 2015 - 2020 from all sources of funding will amount to 565.29 billion rubles, including:

The mechanisms for attracting funds from the budgets of the constituent entities of the Russian Federation (local budgets) and extra-budgetary sources are defined in Section IV of each of the subprograms included in the Program.

The amounts of funding for the Program are given in Appendix No. 2.

V. Mechanism for Program Implementation and Program Management

Management of the implementation of the Program and operational control over the progress of its implementation are provided by the state customer - the coordinator of the Program. The Program Manager is the Minister of Construction, Housing and Utilities of the Russian Federation.

The state customer - the coordinator of the Program will carry out:

development of the legal and regulatory framework required for the implementation of the Program activities;

coordination of the activities of state customers of the activities of the Program and its subprograms and proposals for improving their implementation and the necessary adjustment of the planned activities;

submission to the Ministry of Economic Development of the Russian Federation of consolidated quarterly reports on the implementation of the Program;

monitoring of transformations in the housing sector in order to analyze the situation, generalize positive experience;

clarification of the parameters and composition of the Program activities;

control over the implementation of the Program and its subprograms, analysis of the results of their implementation.

Government customers of the relevant subprograms and activities of the Program will carry out:

organization and selection of the constituent entities of the Russian Federation for participation in the implementation of the subprograms "Providing housing for young families" and "Stimulating programs for the development of housing construction in the constituent entities of the Russian Federation";

implementation, jointly with the state authorities of the constituent entities of the Russian Federation and local self-government bodies, of the subprograms that are part of the Program;

the use of federal budget funds to provide housing for certain categories of citizens, as well as the provision of inter-budgetary transfers to the budgets of the constituent entities of the Russian Federation;

preparation and submission to the state customer - the coordinator of the Program of quarterly reports on the implementation of the subprograms and activities of the Program.

In accordance with the procedure for the development and implementation of federal target programs and interstate target programs, in the implementation of which the Russian Federation participates, approved by the Government of the Russian Federation of June 26, 1995 N 594 "On the implementation of the Federal Law" On the supply of products for federal state needs ", For the purpose of current management of the implementation of the Program and its subprograms, the Ministry of Construction and Housing and Utilities of the Russian Federation may delegate to the federal government agency "United Directorate for the Implementation of Federal Investment Programs" of the Ministry of Construction and Housing and Utilities of the Russian Federation the powers to perform the following functions:

organization of an independent assessment of the effectiveness of the Program;

introduction of information technologies for managing the implementation of the Program and its subprograms, as well as monitoring the implementation of measures to fulfill state obligations to provide housing for the categories of citizens established by federal legislation, provide housing for young scientists, create a specialized the website of the Program and its subprograms;

ensuring interaction with the executive authorities of the constituent entities of the Russian Federation, local self-government bodies, as well as with legal entities participating in the implementation of the Program and its subprograms;

payment for the production of forms of state housing certificates at the expense of funds provided for the management of the implementation of the Program.

Funding for the execution by the federal government agency "United Directorate for the Implementation of Federal Investment Programs" of the Ministry of Construction and Housing and Utilities of the Russian Federation of the functions of managing the implementation of the Program and its subprograms, as well as the implementation of the measures assigned to it, will be carried out at the expense of the federal budget, provided for the management of the implementation of the Program.

The management of the implementation of the Program and its subprograms provides for the participation in this process of federal executive bodies, executive bodies of the constituent entities of the Russian Federation and local self-government bodies.

At the level of the constituent entities of the Russian Federation, the following will be carried out:

development of the regulatory legal framework related to the implementation of federal legislation in the corresponding constituent entity of the Russian Federation;

organizing and conducting information work among the population;

development and implementation of regional programs;

carrying out the activities of the Program, taking into account regional characteristics and best practices.

At the level of local self-government bodies, the following will be carried out:

development and implementation of municipal programs;

conducting Program activities taking into account local specifics and best practices.

The main criterion for the participation of the constituent entities of the Russian Federation and municipalities in the implementation of the Program and its subprograms, along with compliance with the funding requirements for the Program activities (if any), is the implementation of the necessary transformations in their territories, including the development of the regulatory legal framework.

The distribution of federal budget funds between the constituent entities of the Russian Federation within the framework of the subprograms "Stimulating programs for the development of housing construction of the constituent entities of the Russian Federation" and "Provision of housing for young families" will be carried out in accordance with the selection procedures established by these subprograms.

The maximum levels of co-financing of expenditure obligations of the constituent entities of the Russian Federation at the expense of subsidies from the federal budget for 2017, provided within the framework of the federal target program "Housing" for 2015 - 2020, are given in Appendix No. 2 (1).

The level of co-financing of the expenditure obligation of the constituent entity of the Russian Federation through subsidies from the federal budget in 2018 - 2020 will be set in the amount of the maximum level of co-financing approved by the Government of the Russian Federation.

Vi. Assessment of the socio-economic efficiency of the Program

The assessment of the socio-economic efficiency of the Program will be based on a system of target indicators that monitor the dynamics of changes in the housing sector for the reporting period in order to clarify or adjust the tasks and activities.

Monitoring of the implementation of the Program will be carried out by the constituent entities of the Russian Federation and state customers of the Program on a quarterly basis with the provision of information on the results achieved to the Ministry of Construction, Housing and Utilities of the Russian Federation by the 15th day of the month following the reporting quarter.

The methodology for assessing the effectiveness of the implementation of the Program is given in Appendix No. 3.

The expected results of the implementation of the subprograms "Fulfillment of state obligations to provide housing for categories of citizens established by federal legislation", "Provision of housing for young families", "Stimulation of programs for the development of housing construction in the constituent entities of the Russian Federation" and "Provision of housing for certain categories of citizens" are given in the corresponding annexes to the specified subroutines.

Achieving the target values ​​of the indicator of the volume of housing commissioning within the framework of the subprogram "Stimulating programs for the development of housing construction of the constituent entities of the Russian Federation" will contribute to the implementation of the Decree of the President of the Russian Federation of May 7, 2012 N 600 "On measures to provide citizens of the Russian Federation with affordable and comfortable housing and improve the quality housing and communal services ".

I. General Provisions

1. Evaluation of the effectiveness of the implementation of the federal target program "Housing" for 2015 - 2020 (hereinafter referred to as the Program) will be carried out annually based on the use of a system of target indicators, which will monitor the dynamics of changes in the housing sector for the period being assessed in order to clarify the tasks and activities of the Program.

2. To assess the effectiveness of the implementation of the Program, 7 target indicators are used, including 1 comprehensive and 6 corresponding to the main directions of the Program:

a) the level of state support in solving the housing problem of young families (2 indicators);

b) development of housing construction (1 indicator);

c) fulfillment of state obligations to provide housing for the categories of citizens established by federal legislation (2 indicators);

d) provision of housing for certain categories of citizens (1 indicator).

3. To assess the effectiveness of the implementation of the Program as a whole, a complex indicator is used.

To assess the effectiveness of the implementation of the Program in certain areas, indicators in the corresponding area are used.

4. Evaluation of the effectiveness of the Program as a whole and in individual areas is carried out by comparing the actual values ​​of target indicators with the planned values ​​specified in Appendix No. 1 to the Program. Wherein:

a) if the actual values ​​of the indicators are more than 90 percent of the planned values, the effectiveness of the implementation of the Program is assessed as high;

I. Description of the problem to be solved

Within the framework of the subprogram "Provision of housing for young families" of the federal target program "Housing" for 2011 - 2015, for the period of 2011 - 2014, housing conditions were improved, including with the use of mortgage loans and loans, with support from the federal budget, budgets of the constituent entities of the Russian Federation and local budgets of 108.5 thousand young families. The number of constituent entities of the Russian Federation participating in the implementation of the subprogramme's activities has significantly increased, which contributed to the development and adoption in the constituent entities of the Russian Federation of programs to support young families in improving housing conditions and regional programs for the development of mortgage lending.

In the current environment, when credit institutions have established a minimum down payment of at least 30 percent of the cost of housing, the main factors constraining the use of borrowed funds for the purchase or construction of housing are the lack of funds for a significant number of citizens to pay the down payment on a housing or mortgage loan. and also a high interest rate for the use of credit funds, 2 - 2.5 times higher than the average interest rate in developed countries.

As a rule, young families cannot gain access to the housing market without government support. Even if they have a sufficient level of income to obtain a home mortgage loan, young families cannot pay the down payment when receiving a loan. Young families are mainly the purchasers of the first home in their life, which means that they do not own a dwelling that could be used as security for the payment of a down payment when receiving a mortgage or loan. Moreover, most often young families still do not have the opportunity to accumulate the necessary funds for these purposes. However, this category of the population has good prospects for wage growth as they improve their qualifications, and state assistance in providing funds for the payment of an initial payment when receiving mortgage loans or loans will be a good incentive for further professional growth.

Supporting young families in solving the housing problem will become the basis for stable living conditions for this most active part of the population and will affect the improvement of the demographic situation in the country. The possibility of solving the housing problem, including by attracting funds from a mortgage housing loan or a loan, will create an incentive for young people to improve the quality of work and the level of qualifications in order to increase wages. The solution of the housing problem of young citizens of Russia will make it possible to form an economically active stratum of the population.

The need for sustainable functioning of the system for improving the living conditions of young families determines the advisability of using the program-targeted method to solve their housing problem, since this problem:

cannot be resolved within one financial year and requires budgetary expenditures over several years;

is complex in nature and its solution will have an impact on the growth of social well-being and overall economic development.

At the same time, the application of the program-target method to the solution of the tasks set by the subprogram "Provision of housing for young families" of the federal target program "Housing" for 2015 - 2020 (hereinafter referred to as the subprogram) is associated with certain risks. So, in the process of implementing the subprogram, deviations in achieving results are possible due to financial and economic changes in the housing market.

To select options for solving the identified problem, two scenarios for the implementation of the subroutine were considered.

The first scenario (basic) assumes the implementation of the subprogram taking into account the existing restrictions of the federal budget and is aimed at achieving the target values ​​of performance indicators.

The second scenario (optimistic) provides for the acceleration of the implementation of the subprogramme's activities in order to provide state support in providing housing to all young families registered as needing better housing conditions during the period of the subprogramme's implementation.

The implementation of the optimistic scenario presupposes the achievement of significantly higher values ​​of the performance indicators of the subprogram, however, it will require an increase in its funding from the federal budget and the budgets of the constituent entities of the Russian Federation by 140 percent (by 51.74 billion rubles and 120.15 billion rubles, respectively), which significantly exceeds their capabilities. In this regard, the basic scenario for the implementation of the subroutine was chosen as the optimal one.

II. Purpose and objectives, deadlines for implementation and a list of target

indicators and indicators of the subprogram

The purpose of the subprogram is to provide state support in solving the housing problem for young families recognized in the prescribed manner in need of better housing conditions.

The tasks of the subroutine are:

provision of social payments to young families - participants of the subprogramme for the purchase of economy-class housing or the construction of an economy-class residential building (hereinafter - social payments);

creating conditions for young families to attract their own funds, additional funds from credit and other organizations that provide housing loans and loans, including mortgage loans, for the purchase of housing or the construction of individual housing.

The program is being implemented from 2015 to 2020.

Young families - participants of the subprogram can contact an authorized organization, which will acquire, in their interests, an economy-class dwelling on the primary housing market.

The selection of authorized organizations participating in the implementation of the subprogram is carried out by the executive authorities of the constituent entities of the Russian Federation. The criteria for the selection of such authorized organizations, the requirements for them and the rules for the provision of services by them will be determined by the state customer of the subprogram.

The main principles for the implementation of the subroutine are:

voluntary participation in the subprogram of young families;

recognition of a young family in need of better housing conditions in accordance with the requirements of the subprogram;

an opportunity for young families to exercise their right to receive support at the expense of funds provided under the subprogram from the federal budget, the budgets of the constituent entities of the Russian Federation and (or) local budgets to improve housing conditions only once.

The conditions for terminating the implementation of the subprogram are the early achievement of the goal and objectives of the subprogram, as well as a change in the mechanisms for implementing the state housing policy.

Target indicators and indicators of the subprogram are given in Appendix N 1.

III. Activities of the subprogram

The implementation of the activities of the subprogram is carried out in the following areas:

methodological support for the implementation of the subprogram;

financial support for the implementation of the subprogram;

organizational support for the implementation of the subprogram.

The list of the main activities for the implementation of the subprogram is given in Appendix No. 2.

The main measures for the regulatory and organizational support for financing the subprogram are the development of financial and economic mechanisms for providing state support to young families to improve their living conditions and the preparation of the necessary feasibility studies and calculations for the development of federal budget projects for the corresponding year and planning period.

Organizational measures at the federal level include:

accepting applications from the constituent entities of the Russian Federation for participation in the subprogram;

the conclusion by the state customer of the subprogram with the supreme executive bodies of state power of the constituent entities of the Russian Federation of agreements on the provision of subsidies for the implementation of the subprogram;

control over the implementation of the subroutine.

Organizational activities at the regional level include:

collection of data on young families participating in the subprogram, provided by local government bodies that ensure the implementation of the activities of the subprogram, and the formation of a unified information database on the participants of the subprogram in the constituent entity of the Russian Federation;

IV. Resource support of the subroutine

The main sources of funding for the subprogram are:

federal budget funds provided in the form of subsidies to the budgets of the constituent entities of the Russian Federation to co-finance the activities of the subprogram;

funds from the budgets of the constituent entities of the Russian Federation and local budgets;

funds of credit and other organizations providing loans and loans to young families for the purchase of housing or the construction of a residential building, including mortgages;

funds of young families used for partial payment of the cost of the acquired dwelling or the construction of a dwelling house.

V. Mechanism of subroutine implementation

and subprogramme management

The mechanism for the implementation of the subprogram involves the provision of state support to young families - participants in the subprogram in improving their living conditions by providing them with social benefits.

The condition for the provision of social benefits is that a young family, in addition to the right to receive social benefits, additional funds, including own funds or funds received under a loan agreement (loan agreement) for the purchase (construction) of housing, a mortgage housing contract, necessary to pay for construction or purchasing a living space. As additional funds, a young family can also use funds (part of the funds) of the maternity (family) capital.

The condition for participation in the subprogram and the provision of social benefits is the consent of adult members of a young family to the processing of personal data on members of a young family by local authorities, executive bodies of the constituent entity of the Russian Federation and federal executive bodies.

Consent must be formalized in accordance with Article 9 of the Federal Law "On Personal Data".

As a mechanism for bringing social benefits to a young family, a certificate of the right to receive social benefits for the purchase of housing or the construction of a residential building (hereinafter referred to as the certificate) will be used, which will be issued by the local government that has decided on the participation of the young family in the subprogram. The certificate is handed over by its owner to a bank selected by the executive authority of the constituent entity of the Russian Federation for servicing funds provided for the provision of social benefits, in which a bank account is opened in the name of a member of a young family intended for crediting social benefits. A young family - the owner of the certificate concludes a bank account agreement with the bank at the place of purchase of housing.

The selection of banks for participation in the implementation of the subprogram will be carried out by the constituent entities of the Russian Federation participating in the implementation of the subprogram. The criteria for the selection of banks will be determined by the state customer of the subprogram together with the Central Bank of the Russian Federation.

It is assumed that banks applying for participation in the subprogram must meet the following conditions:

experience in housing lending to the population (the term of implementation of housing lending to the population is more than one year);

absence of arrears in payment of tax payments to the budgets of all levels;

compliance with the mandatory standards of banks established by the Central Bank of the Russian Federation;

no losses for the last reporting year;

the presence of a structural subdivision of the bank on the territory of a constituent entity of the Russian Federation participating in the implementation of the subprogram;

the development of the network of branches on the territory of the constituent entities of the Russian Federation participating in the implementation of the subprogram.

Social payments will be provided by the local government, which made a decision on the participation of a young family in the subprogram, at the expense of the local budget provided for the implementation of the activities of the subprogram, including through subsidies from the budget of the constituent entity of the Russian Federation, in accordance with the Rules for the provision of social benefits to young families for the purchase (construction) of housing and their use, given in Appendix No. 4 to the subprogram.

The provision of subsidies from the federal budget to the budgets of the constituent entities of the Russian Federation for co-financing the expenditure obligations of the constituent entities of the Russian Federation for the provision of social benefits to young families for the purchase (construction) of housing will be carried out in accordance with the Rules for the provision of subsidies from the federal budget to the budgets of the constituent entities of the Russian Federation for co-financing the expenditure obligations of the constituent entities of the Russian Federation for the provision of social benefits to young families for the purchase (construction) of housing, listed in Appendix No. 5.

When implementing the subprogram in 2015, the form of an agreement on the provision of subsidies from the federal budget to the budgets of the constituent entities of the Russian Federation is used to co-finance the expenditure obligations of the constituent entities of the Russian Federation for the provision of social payments to young families for the purchase (construction) of housing, approved by the Ministry of Construction, Housing and Communal Services of the Russian Federation in within the framework of the federal target program "Housing" for 2011 - 2015.

Possible forms of participation of organizations in the implementation of the subprogram, with the exception of organizations providing loans (loans) for the purchase or construction of housing, including mortgages, can be participation in the co-financing of the provision of social benefits, the provision of material and technical resources for the construction of housing for young families - participants subroutines, as well as other forms of support. PROVIDING YOUNG FAMILIES SOCIAL BENEFITS

FOR THE PURCHASE (CONSTRUCTION) OF HOUSING AND THEIR USE

1. These Rules establish the procedure and goals for providing young families with social payments for the purchase of housing or the creation of an individual housing construction object (hereinafter referred to as a residential building, social payment), as well as the use of such payments.

2. Social payments are used:

a) to pay the price of the contract for the sale and purchase of residential premises (except for cases where payment of the price of the purchase and sale agreement is provided for as part of the price of an agreement with an authorized organization for the purchase of economy class residential premises in the primary housing market);

b) to pay the price of a construction contract for the construction of a residential building (hereinafter - a construction contract);

( hereinafter referred to as a cooperative);

d) to pay the initial payment when receiving a home loan, including a mortgage, or a home loan for the purchase of a dwelling or the construction of a dwelling house;

e) to pay the price of an agreement with an authorized organization for the acquisition in the interests of a young family of an economy-class dwelling in the primary housing market, including for payment of the price of a contract for the sale and purchase of a dwelling (in cases where this is provided for by an agreement with an authorized organization) and (or ) payment for the services of the specified organization;

f) for the repayment of the principal amount of the debt and the payment of interest on housing loans, including mortgages, or housing loans for the purchase of residential premises or the construction of a residential building, with the exception of other interest, fines, commissions and penalties for late fulfillment of obligations on these loans or borrowings ...

2 (1). Social benefits cannot be used to purchase housing from close relatives (spouse (wife), grandfather (grandmother), grandchildren, parents (including adoptive parents), children (including adopted children), full and half brothers and sisters).

3. The right of a young family - a participant in the subprogram "Provision of housing for young families" of the federal target program "Housing" for 2015 - 2020 (hereinafter - the subprogram) to receive social benefits is certified by a personal document - a certificate of the right to receive social benefits, which is not valuable paper.

4. Issuance of a certificate of the right to receive social benefits in the form in accordance with Appendix No. 1 to the Rules on the basis of a decision to include a young family in the list of participants in the subprogram is carried out by the local government of the municipal formation, selected by the subject of the Russian Federation for participation in the subprogram (hereinafter - the local government ), in accordance with an extract from the list of young families - applicants for social benefits in the corresponding year, approved by the executive authority of the constituent entity of the Russian Federation.

Payment for the production of forms of certificates of the right to receive social benefits is carried out by the executive authority of the constituent entity of the Russian Federation at the expense of the budget of the constituent entity of the Russian Federation, provided for financing the subprogram. Forms of certificates are transferred to local governments in accordance with the number of young families - applicants for social benefits in the relevant year.

5. The validity period of the certificate of the right to receive social benefits is no more than 7 months from the date of issue specified in this certificate.

6. A participant in the subprogram can be a young family, including a young family with one child or more, where one of the spouses is not a citizen of the Russian Federation, as well as an incomplete young family consisting of one young parent who is a citizen of the Russian Federation and one a child or more that meet the following requirements:

a) the age of each of the spouses or one parent in an incomplete family on the day of the decision by the executive authority of the constituent entity of the Russian Federation to include a young family participating in the subprogram in the list of applicants for social benefits in the planned year does not exceed 35 years;

b) a young family is recognized as needing a living quarters in accordance with paragraph 7 of these Rules;

c) the family has income that allows it to get a loan, or other funds sufficient to pay the estimated (average) cost of housing in the part that exceeds the amount of social benefits provided.

7. In these Rules, those in need of housing are understood as young families registered as needing better housing conditions before March 1, 2005, as well as young families recognized by local governments at their place of permanent residence as needing housing after March 1, 2005 on the same grounds as established by Article 51 of the Housing Code of the Russian Federation for recognizing citizens as needing residential premises provided under social tenancy agreements, regardless of whether they are registered as needing residential premises.

When determining the level of provision for a young family with the total area of ​​living quarters, the total size of the total area of ​​all habitable living quarters occupied by members of a young family under social employment contracts and (or) residential quarters and (or) part of the living quarters (residential quarters) is taken into account, owned by members of a young family on the basis of ownership.

8. The procedure and conditions for recognizing a young family with sufficient income to obtain a loan, or other funds to pay the estimated (average) cost of housing in the part exceeding the amount of the provided social benefits, are established by the state authority of the constituent entity of the Russian Federation.

9. The right to improve housing conditions using social benefits is granted to a young family only once. Participation in the subprogramme is voluntary.

10. Social payments are provided in the amount of at least:

a) 30 percent of the estimated (average) cost of housing, determined in accordance with these Rules, for young families without children;

b) 35 percent of the estimated (average) cost of housing, determined in accordance with these Rules, for young families with one child or more, as well as for incomplete young families consisting of one young parent and one child or more.

11. In the case of using the social payment for the purpose provided for by sub-clause "c" of clause 2 of these Rules, its amount is established in accordance with clause 10 of these Rules and is limited to the amount of the outstanding balance of the balance of the share.

12. In the case of using a social payment for the purpose provided for in subparagraph "e" of paragraph 2 of these Rules, the amount of the social payment is established in accordance with paragraph 10 of these Rules and is limited to the amount of the balance of the principal debt and the balance of the debt on payment of interest for the use of a mortgage loan or loan , with the exception of other interest, fines, commissions and penalties for late fulfillment of obligations under these loans or borrowings.

13. The calculation of the amount of social benefits is based on the size of the total area of ​​the living quarters, established in accordance with paragraph 15 of these Rules, the number of members of a young family participating in the subprogram and the standard cost of 1 sq. meters of the total area of ​​housing in the municipality, in which a young family is included in the list of participants in the subprogram. Cost standard for 1 sq. meters of the total area of ​​housing in the municipality for calculating the amount of social benefits is established by the local government, but not higher than the average market value of 1 sq. meters of the total area of ​​housing in the constituent entity of the Russian Federation, determined by the Ministry of Construction, Housing and Communal Services of the Russian Federation.

14. The calculation of the amount of social benefits for a young family in which one of the spouses is not a citizen of the Russian Federation is carried out in accordance with paragraph 13 of these Rules based on the size of the total area of ​​living quarters established for families of different sizes, taking into account family members who are citizens of the Russian Federation. Federation.

15. The size of the total area of ​​the dwelling, taking into account which the amount of social benefits is determined, is:

a) for a family of 2 people (young spouses or one young parent and child) - 42 sq. meters;

b) for a family of 3 or more people, including, in addition to young spouses, one child or more (or a family consisting of one young parent and 2 or more children) - 18 sq. meters per person.

16. The estimated (average) cost of housing used in calculating the amount of social benefits is determined by the formula:

StZh = H x RZh,

H is the standard for the cost of 1 sq. meter of the total area of ​​housing in the municipality, determined in accordance with the requirements established by paragraph 13 of these Rules;

РЖ - the size of the total area of ​​the living quarters, determined in accordance with paragraph 15 of these Rules.

17. The amount of social benefits is calculated as of the date of approval by the executive authority of the constituent entity of the Russian Federation of lists of young families - applicants for social benefits, is indicated in the certificate of the right to receive social benefits and remains unchanged throughout its validity period.

18. To participate in the subprogram in order to use social benefits in accordance with subparagraphs "a" - "e" of paragraph 2 of these Rules, a young family shall submit the following documents to the local government at the place of residence:

a) an application in the form according to Appendix No. 2 in 2 copies (one copy is returned to the applicant indicating the date of acceptance of the application and the documents attached to it);

b) a copy of the identity documents of each family member;

d) a document confirming the recognition of a young family in need of living quarters;

e) documents confirming the recognition of the young family as having income that allows them to get a loan, or other funds to pay the estimated (average) cost of housing in the part that exceeds the amount of social benefits provided.

19. To participate in the subprogram in order to use social benefits in accordance with subparagraph "e" of paragraph 2 of these Rules, a young family shall submit the following documents to the local government body at the place of residence:

a) an application in the form in accordance with Appendix No. 2 to these Rules in 2 copies (one copy is returned to the applicant indicating the date of acceptance of the application and the documents attached to it);

b) copies of documents proving the identity of each family member;

c) a copy of the marriage certificate (does not apply to an incomplete family);

d) an extract (extracts) from the Unified State Register of Real Estate on the rights to a residential premises (residential building) acquired (built) using the funds of a mortgage loan (loan), or a construction contract or other documents confirming the costs of building a residential building ( further - documents for construction), - in case of unfinished construction of a residential building;

e) a copy of the loan agreement (loan agreement);

f) a document confirming that the young family was recognized as needing a dwelling in accordance with paragraph 7 of these Rules at the time of the conclusion of the loan agreement (loan agreement) specified in subparagraph "e" of this paragraph;

g) certificate of the lender (lender) on the amount of the balance of the principal debt and the amount of debt on the payment of interest for the use of a mortgage loan (loan).

20. The documents provided for in clauses 18 or 19, 31 and 32 of these Rules may be submitted on behalf of a young family by one of its adult members or another authorized person in the presence of duly issued powers.

21. The local self-government body organizes work to verify the information contained in the documents provided for in paragraphs 18 or 19 of these Rules, and within 10 days from the date of submission of these documents makes a decision on the recognition or refusal to recognize the young family as a participant in the subprogram. The young family is notified of the decision taken by the local government body within 5 days.

22. The grounds for refusal to recognize a young family as a participant in the subprogram are:

a) non-compliance of the young family with the requirements provided for in paragraph 6 of these Rules;

b) failure to submit or submission not in full of the documents provided for in clauses 18 or 19 of these Rules;

c) inaccuracy of the information contained in the submitted documents;

d) the previously realized right to improve housing conditions using social payments or other form of state support at the expense of the federal budget, with the exception of funds (part of funds) of maternity (family) capital.

23. Re-applying with an application for participation in the subprogramme is allowed after the removal of the grounds for refusal, provided for in paragraph 22 of these Rules.

24. The local self-government body, before September 1 of the year preceding the planned one, forms lists of young families - participants of the subprogram who have expressed a desire to receive social benefits in the planned year, and submits these lists to the executive body of the constituent entity of the Russian Federation.

25. The procedure for the formation by the local government body of a list of young families - participants of the subprogram who have expressed a desire to receive social benefits in the planned year, and the form of this list are determined by the executive authority of the subject of the Russian Federation. First of all, these lists include young families - participants of the subprogram, registered as needing better housing conditions before March 1, 2005, as well as young families with 3 or more children.

26. The executive authority of the constituent entity of the Russian Federation on the basis of the lists of young families - participants of the subprogram, who have expressed a desire to receive social benefits in the planned year, received from local governments, and taking into account the funds that are planned to be allocated for co-financing of the activities of the subprogram from the budget of the constituent entity of the Russian Federation and (or) local budgets for the corresponding year, and (if available) funds provided by organizations participating in the implementation of the subprogram, with the exception of organizations providing housing loans and loans, forms and approves a consolidated list of young families - participants in the subprogram who have expressed a desire to receive social benefits in the planned year, according to the form approved by the state customer of the subprogram.

27. After the approval by the Government of the Russian Federation of the amount of the subsidy provided to the budget of the constituent entity of the Russian Federation for the planned (current) year, and the subprogram of this information is communicated by the state customer to the executive authorities of the constituent entities of the Russian Federation, the executive authority of the constituent entity of the Russian Federation on the basis of the consolidated list of young families - participants subprograms that have expressed a desire to receive a social payment in the planned year, and taking into account the amount of subsidies provided from the federal budget, the amount of budgetary allocations envisaged in the budget of the constituent entity of the Russian Federation and (or) local budgets for the corresponding year to co-finance the activities of the subprogram, and (if available ) funds provided by organizations participating in the implementation of the subprogram, with the exception of organizations providing housing loans and loans, approves the lists of young families - applicants for social benefits in the relevant year.

If at the time of the formation by the executive authority of the constituent entity of the Russian Federation lists of young families - applicants for social benefits in the corresponding year, the age of one of the members of the young family exceeds 35 years, such a family shall be excluded from the list of young families - participants of the subprogram in the manner established by the body executive power of the constituent entity of the Russian Federation.

28. The executive power body of the constituent entity of the Russian Federation, within 10 days from the date of approval of the lists of young families - applicants for social benefits in the corresponding year, brings to the local authorities extracts from the approved list of young families - applicants for social benefits in the relevant year.

The local self-government body informs young families - participants of the subprogram who have expressed a desire to receive social benefits in the corresponding year, the decision of the executive authority of the constituent entity of the Russian Federation on their inclusion in the list of young families - applicants for social benefits in the corresponding year.

28 (1). The executive body of the constituent entity of the Russian Federation, within 10 working days after receiving a notification about the limits of budgetary obligations envisaged for the provision of subsidies from the federal budget to the budget of the constituent entity of the Russian Federation, intended for the provision of social payments, shall send to local governments a notification of the limits of budgetary obligations provided for the provision of subsidies from the budget of the constituent entity of the Russian Federation to local budgets intended for the provision of social benefits.

29. The local self-government body, within 5 working days after receiving a notification about the limits of budgetary obligations provided for the provision of subsidies from the budget of a constituent entity of the Russian Federation, intended for the provision of social payments, notifies in a way that allows to confirm the fact and date of notification, young families - applicants for social benefits in the relevant year on the need to submit documents to obtain a certificate of the right to receive social benefits, and also explains the procedure and conditions for receiving and using social benefits provided under this certificate.

30. Within one month after receiving a notification about the limits of budgetary allocations from the budget of a constituent entity of the Russian Federation intended for the provision of social benefits, the local government shall issue certificates of the right to receive social benefits and issue them to young families - applicants for social benefits in accordance with with a list of young families - applicants for receiving social benefits in the corresponding year, approved by the executive authority of the constituent entity of the Russian Federation.

The executive body of a constituent entity of the Russian Federation may, in the manner prescribed by it, amend the approved lists of young families - applicants for social benefits in the corresponding year, if young families - applicants for social benefits have not submitted the necessary documents to obtain a certificate of the right to receive social benefits within the period specified in clause 31 of these Rules, or during the validity period of the certificate of the right to receive social benefits, they refused to receive social benefits, or for other reasons could not use this social benefit.

31. In order to obtain a certificate of the right to receive social benefits, a young family - an applicant for social benefits in the relevant year, within 15 working days after receiving notification of the need to submit documents to obtain a certificate of the right to receive social benefits, sends to the local government decision on recognizing a young family as a participant in the subprogram, an application for the issuance of such a certificate (in any form) and documents:

a) provided for by subparagraphs "b" - "e" of paragraph 18 of these Rules, in the case of using social payments in accordance with subparagraphs "a" - "e" of paragraph 2 of these Rules;

b) provided for by subparagraphs "b" - "e" and "g" of paragraph 19 of these Rules, in the case of using social payments in accordance with subparagraph "f" of paragraph 2 of these Rules.

32. In the application for the issue of a certificate of the right to receive social benefits, the young family gives written consent to receive social benefits in the manner and on the conditions established by these Rules.

33. The local self-government body organizes work to verify the information contained in the documents specified in paragraph 31 of these Rules.

Grounds for refusing to issue a certificate of the right to receive social benefits are violation of the time period for submission of the necessary documents for obtaining a certificate established by paragraph 31 of these Rules, failure to submit or submission of the specified documents in full, inaccuracy of the information contained in the submitted documents, as well as inadequacy of the living quarters (residential building) acquired (built) with the help of borrowed funds, the requirements of paragraph 38 of these Rules.

34. If a young family participating in the subprogramme has circumstances that require replacement of the issued certificate of the right to receive social benefits, the young family submits to the local government that issued this certificate, an application for its replacement, indicating the circumstances that required such replacement, and the attachment of documents confirming these circumstances. Such circumstances include the loss (theft) or damage of this certificate and good reasons that did not allow the young family to submit it on time to the bank selected to service the funds provided as social benefits allocated to young families - participants of the subprogram (hereinafter referred to as the bank) ...

Within 30 days from the date of receipt of the application for replacing the certificate of the right to receive social benefits, the local government that issued this certificate issues a new certificate of the right to receive social benefits, which indicates the amount of social benefits provided for in the replaced certificate and the validity period corresponding to the remaining validity period.

35. Social payments are provided to the owner of a certificate of the right to receive social payments in non-cash form by crediting the appropriate funds to his bank account opened with the bank, based on the bank's application for transferring budgetary funds.

The owner of the certificate of the right to receive social benefits shall submit this certificate to the bank within 1 month from the date of its issue.

The bank does not accept the certificate of the right to receive social benefits presented to the bank after one month from the date of its issuance. Upon the expiration of this period, the owner of the certificate of the right to receive social benefits has the right to apply in the manner prescribed by paragraph 34 of these Rules to the local government that issued this certificate with an application for its replacement.

The bank checks the compliance of the data specified in the certificate of the right to receive social benefits with the data contained in the identity documents of the owner of this certificate, as well as the timeliness of submission of this certificate to the bank.

The bank enters into a bank account agreement with the owner of the certificate of the right to receive social benefits and opens a bank account in his name to record funds provided as social benefits. In case of revealing a discrepancy between the data specified in the certificate of the right to receive social benefits, the data contained in the submitted documents, the bank refuses to conclude a bank account agreement and returns the certificate of the right to receive social benefits to its owner.

36. The bank account agreement establishes the conditions for servicing a bank account, the procedure for the relationship between the bank and the owner of the certificate of the right to receive social benefits, in whose name the bank account is opened (hereinafter referred to as the account manager), as well as the procedure for transferring funds from the bank account. The bank account agreement may indicate the person who is entrusted with managing the specified account, and the conditions for transferring the funds received to the bank account of the account manager.

The bank account agreement is concluded for the period remaining until the expiration of the certificate of the right to receive social benefits, and may be terminated during the term of the agreement upon a written application from the account manager. In case of early termination of the bank account agreement (if the funds provided as a social payment were not credited to the specified account), the bank issues the account manager with a certificate of termination of the bank account agreement without transferring the social payment funds. The certificate of the right to receive social benefits submitted to the bank is not returned to the owner after the conclusion of the bank account agreement.

37. The bank submits on a monthly basis, by the 10th, to the local self-government body information as of the 1st date on the facts of concluding bank account agreements with holders of certificates of the right to receive social benefits, on refusal to conclude agreements, their termination without crediting funds provided as a social benefit, and on the transfer of funds from a bank account to pay for the purchased dwelling (construction of a dwelling house).

38. The account manager has the right to use social benefits for the purchase of residential premises from any individuals and (or) legal entities, both in the primary and secondary housing markets, or for the construction of a residential building that meets the requirements established by Articles 15 and 16 of the Housing Code of the Russian Federation , improved in relation to the conditions of the settlement in which the residential premises for permanent residence are purchased (built).

The dwelling to be purchased must be located or the construction of a dwelling house must be carried out on the territory of the constituent entity of the Russian Federation, the executive body of which has included a young family - a participant in the subprogram in the list of applicants for receiving social benefits.

In the case of using social benefits in accordance with subparagraphs "a" - "e" of clause 2 of these Rules, the total area of ​​the acquired residential premises (residential building under construction) per each member of the young family taken into account when calculating the amount of social benefits, cannot be less than the accounting the norms of the total area of ​​living quarters established by local governments in order to register citizens as those in need of living quarters at the place of purchase of a dwelling or construction of a dwelling house.

In the case of using social benefits in accordance with subparagraph "e" of paragraph 2 of these Rules, the total area of ​​the acquired residential premises (residential building under construction) per each member of the young family on the date of state registration of ownership of such residential premises (residential building) cannot be less than the accounting norm for the total area of ​​residential premises established by local governments in order to register citizens as needing residential premises at the place of purchase of residential premises or construction of a residential building.

Young families - participants in the subprogramme can attract their own funds, maternity (family) capital and loans or borrowings provided by any organizations and (or) individuals in order to acquire housing (construction of a residential building).

39. To pay for the purchased dwelling or the construction of a dwelling house, the account manager submits to the bank a bank account agreement, a dwelling sale and purchase agreement or a construction contract, an extract (extracts) from the Unified State Register of Real Estate on the rights to the dwelling to be acquired (built dwelling house ) and documents confirming the availability of sufficient funds to pay for the purchased residential premises or a residential building under construction in the part exceeding the amount of the provided social benefits.

In the sale and purchase agreement for residential premises or construction contracts, the details of the certificate of the right to receive social benefits (series, number, date of issue, the authority that issued the certificate) and the bank account (bank accounts) from which operations will be carried out to pay for the residential premises are indicated or a residential house, acquired or under construction on the basis of this contract of sale of residential premises or a construction contract, as well as the procedure for paying an amount in excess of the amount of social benefits provided.

40. In the event that an economy class dwelling is purchased by an authorized organization providing services for young families - participants of the subprogram, the account manager submits to the bank a bank account agreement and an agreement with the above organization. The terms of a model agreement with an authorized organization are approved by the Ministry of Construction, Housing and Utilities of the Russian Federation.

The contract with an authorized organization providing services for young families - participants of the subprogramme specifies the details of the certificate of the right to receive social benefits (series, number, date of issue, the authority that issued this certificate), the authorized organization and its bank account (bank accounts) , as well as the procedure for paying the amount in excess of the amount of the provided social benefits required for the purchase of an economy-class dwelling on the primary housing market.

41. In the case of using social payments for the purpose provided for in subparagraph "d" of paragraph 2 of these Rules, the account manager shall submit to the bank:

a) bank account agreement;

c) in the case of the acquisition of residential premises - a contract for the sale and purchase of residential premises;

d) in the case of the construction of a residential building - a construction contract.

42. In the case of using social payments for the purpose provided for in subparagraph "e" of paragraph 2 of these Rules, the account manager shall submit the following documents to the bank:

a) bank account agreement;

b) credit agreement (loan agreement);

c) an extract (extracts) from the Unified State Register of Real Estate on the rights to the acquired residential premises or documents for construction - in case of unfinished construction of a residential building;

d) a certificate of the lender (lender) on the remaining part of the principal debt and the amount of debt on the payment of interest for the use of a mortgage loan (loan).

43. The acquired dwelling space or the constructed dwelling house shall be registered in the common ownership of all members of the young family indicated in the certificate of the right to receive social benefits.

In the case of using the means of social payments for the purposes stipulated by subparagraphs "d" and "f" of paragraph 2 of these Rules, it is allowed to register the acquired residential premises or built residential buildings in the ownership of one of the spouses or both spouses. In this case, the person (persons) in whose name the ownership of a residential premises or residential building is registered, submits to the local government a notarized obligation to re-register the residential premises acquired with the help of a social payment or a residential building built with the help of a social payment into the common ownership of all family members specified in the certificate of the right to receive social benefits, within 6 months after the removal of the encumbrance from the dwelling or dwelling house.

44. In the event that social payments are directed to the purpose provided for in subparagraph "c" of paragraph 2 of these Rules, the account manager shall submit to the bank:

a) a certificate of the remaining unpaid amount of the share contribution necessary for the acquisition by him of the right of ownership to the residential premises transferred by the cooperative for his use;

b) a copy of the charter of the cooperative;

c) an extract from the register of members of the cooperative, confirming its membership in the cooperative;

d) an extract (extracts) from the Unified State Register of Real Estate on the rights of a cooperative to a dwelling that was purchased for a young family - a participant in the subprogram;

e) a copy of the decision on the transfer of residential premises for the use of a member of the cooperative.

45. In the event that social payments are directed to the purpose provided for in subparagraph "b" of paragraph 2 of these Rules, the account manager shall submit to the bank:

a) documents confirming the right of ownership, permanent (indefinite) use or life-long inherited possession of members of a young family to a land plot;

b) a building permit issued to one of the members of a young family;

c) a building contract, providing information on the total area of ​​a residential building planned for construction, and calculating the cost of work performed to build a residential building.

46. ​​The Bank, within 5 working days from the date of receipt of the documents provided for in clauses 39 - 42, 44 and subparagraphs "a" and "b" of clause 45 of these Rules, verifies the information contained therein, including checking the conformity of the houses) the conditions for classifying residential premises as economy class housing, approved by the Ministry of Construction, Housing and Communal Services of the Russian Federation.

In the event the bank makes a decision to refuse to accept the contract for the sale and purchase of residential premises, documents for construction and documents provided for in paragraphs 41, 42, 44 and subparagraphs "a" and "b" of paragraph 45 of these Rules, or on the refusal to pay On the basis of these documents or the payment of the remainder of the share contribution, the account manager shall be given a written notification within 5 working days from the date of receipt of the said documents, indicating the reasons for the refusal. In this case, the documents accepted by the bank for verification are returned.

The originals of the contract for the sale and purchase of residential premises, documents for construction and documents provided for in paragraphs 41, 42, 44 and subparagraphs "a" and "b" of paragraph 45 of these Rules are kept in the bank until funds are transferred to the person indicated in them or until such transfer and then returned to the account holder.

The bank, within one working day after making a decision on the acceptance of the contract for the sale of residential premises, documents for construction and documents provided for in paragraphs 41, 42, 44 and subparagraphs "a" and "b" of paragraph 45 of these Rules, shall send to the local government an application for the transfer of budgetary funds towards payment of expenses on the basis of the specified documents.

47. The local government body, within 5 working days from the date of receipt from the bank of the application for transferring funds from the local budget to the bank account, checks it for compliance with the data on the issued certificates of the right to receive social benefits and, if they match, transfers to the bank the funds provided as social payments. If the data does not correspond, the transfer of the indicated funds is not made, about which the local self-government body shall notify the bank in writing within the specified period.

48. The transfer of funds from the bank account to the person in favor of whom the account manager must make the payment is carried out in a non-cash form within 5 working days from the date of receipt of funds from the local budget for the provision of social payments to the bank account.

49. By agreement of the parties, the bank account agreement may be extended if:

a) before the expiration of the bank account agreement, the bank has accepted the sale and purchase agreement for residential premises, documents for construction and documents provided for in paragraphs 41, 42, 44 and subparagraphs "a" and "b" of paragraph 45 of these Rules, but payment has not been made;

b) before the expiration of the bank account agreement, a receipt is submitted to the bank from the body that carries out state registration of rights to real estate and transactions with it, on the receipt by it of documents for state registration of ownership of the acquired residential premises or built residential building, indicating the period for registration of state registration the specified right. In this case, the document, which is the basis for state registration of ownership of the acquired residential premises or built residential building, and documents of title to the residential premises or residential building are submitted to the bank no later than 2 working days after the expiration of the period provided for in the receipt of the specified authority, and acceptance the bank of the contract for the sale of residential premises for payment is carried out in the manner prescribed by paragraph 46 of these Rules.

50. Social payment is considered to be provided to the participant of the subprogram from the date of execution by the bank of the order of the account manager on the transfer by the bank of the funds credited to the bank account of the account manager for the purposes provided for in paragraph 2 of these Rules.

51. Certificates of the right to receive social benefits held by the bank are redeemed by the bank in accordance with the procedure established by it. Canceled certificates are subject to storage for 3 years. Certificates of the right to receive social benefits that are not presented to the bank in the manner and terms established by these Rules are considered invalid.

52. If the owner of the certificate of the right to receive social benefits for any reason could not, within the established period of validity of this certificate, exercise the right to receive the social benefits allocated to him, he submits to the local government that issued the certificate a certificate of termination of the banking agreement. accounts without transferring social benefits and retains the right to improve housing conditions, including further participation in the subprogram on a general basis.

1. These Rules establish the procedure and conditions for the provision and distribution of subsidies from the federal budget to the budgets of the constituent entities of the Russian Federation for co-financing the expenditure obligations of the constituent entities of the Russian Federation for the provision of social benefits to young families for the purchase (construction) of housing within the framework of the subprogram "Provision of housing for young families" of the federal target program "Housing" for 2015 - 2020 (hereinafter, respectively - social payment, subsidy, subprogram).

5. The distribution of subsidies between the budgets of the constituent entities of the Russian Federation is carried out based on the amount of funds provided to the budget of the constituent entity of the Russian Federation.

The amount of funds to be provided to the budget of a constituent entity of the Russian Federation is determined by the formula:

7. The level of co-financing of the expenditure obligation of the i-th constituent entity of the Russian Federation at the expense of subsidies is determined by the formula:

RBO i - the level of estimated budgetary provision of the i-th constituent entity of the Russian Federation for the next financial year, calculated in accordance with the method of allocating subsidies to equalize the budgetary provision of constituent entities of the Russian Federation, approved by the Government of the Russian Federation of November 22, 2004 N 670 "On the distribution of subsidies to equalize the budgetary provision of the constituent entities of the Russian Federation ".

The level of co-financing of the expenditure obligation of the i-th constituent entity of the Russian Federation, accepted for calculating the amount of the subsidy, cannot exceed the maximum level of co-financing established for this constituent entity of the Russian Federation in accordance with paragraph 8 (1) of these Rules.

7 (1). If the amount of funds provided for in the consolidated budget of a constituent entity of the Russian Federation for financing activities for which the subsidy is provided does not provide the level of co-financing from the federal budget, determined in accordance with paragraph 7 of these Rules, the amount of the subsidy shall be reduced to the amount that provides the appropriate level co-financing.

8 (1). The maximum levels of co-financing of expenditure obligations of the constituent entities of the Russian Federation at the expense of subsidies from the federal budget for 2017 provided under the federal target program "Housing" for 2015 - 2020 are given in Appendix No. 2 (1) to the federal target program "Housing" for 2015 - 2020 years.

9. The distribution of federal budget funds between the budgets of the constituent entities of the Russian Federation in 2015 - 2017 is approved by the Government of the Russian Federation.

9 (1). If the amount of funds determined to provide a subsidy to the budget of a constituent entity of the Russian Federation is less than the maximum amount of federal budget funds requested by the constituent entity of the Russian Federation to co-finance the activities of the subprogram, the funds provided for in the budget of the constituent entity of the Russian Federation and local budgets and taken into account when distributing the subsidy are not subject to reduction. ...

10. Subsidies are granted subject to the following conditions:

a) the existence of a regulatory legal act of the constituent entity of the Russian Federation establishing the expenditure obligation of the constituent entity of the Russian Federation, for the execution of which a subsidy is provided;

b) the existence of an approved state program of the constituent entity of the Russian Federation, providing for the provision of social benefits in accordance with the terms of the subprogram.

c) return of funds by a constituent entity of the Russian Federation to the federal budget in accordance with clause 21 of these Rules;

11. Granting subsidies to the budget of a constituent entity of the Russian Federation is carried out on the basis of a subsidy agreement concluded no later than March 1 of the year of granting the subsidy between the Ministry of Construction, Housing and Utilities of the Russian Federation and the supreme executive body of state power of the constituent entity of the Russian Federation (hereinafter referred to as the agreement).

12. The agreement contains the following provisions:

a) the details of the regulatory legal act of the constituent entity of the Russian Federation establishing the expenditure obligation of the constituent entity of the Russian Federation, for the execution of which the subsidy is provided;

b) the size of the subsidy, the procedure, conditions and terms for its transfer and spending, as well as the amount of budgetary allocations from the budget of the constituent entity of the Russian Federation and (or) municipal budgets for the implementation of the corresponding expenditure obligations;

c) the procedure for exercising control over compliance by the constituent entity of the Russian Federation with the conditions established when granting a subsidy;

d) the timing and procedure for reporting on the implementation of budget expenditures of the constituent entity of the Russian Federation, the source of financial support for which is the subsidy, as well as on the achievement of the values ​​of the performance indicators of the use of the subsidy;

e) the value of the indicator of the effectiveness of the use of the subsidy, determined taking into account the values ​​of the target indicators and indicators of the subprogram, and the obligations of the constituent entity of the Russian Federation to achieve it;

f) the consequences of the failure of the constituent entity of the Russian Federation to achieve the established values ​​of the performance indicators for the use of the subsidy;

g) obligations of the constituent entity of the Russian Federation in agreement with the Ministry of Construction and Housing and Utilities of the Russian Federation of the state program of the constituent entity of the Russian Federation, co-financed from the federal budget, and amendments to it that entail changes in the amount of funding and (or) performance indicators, and (or) the composition of the activities of the specified program, for the co-financing of which subsidies are provided;

h) responsibility of the parties for violation of the terms of the agreement;

13. The agreement is concluded in accordance with the standard form of the agreement approved by the Ministry of Finance of the Russian Federation.

14. The transfer of subsidies to the budgets of the constituent entities of the Russian Federation is carried out in the manner established by the Government of the Russian Federation.

14 (1). In order to provide social payments, the funds received in the budget of the constituent entity of the Russian Federation (local budget) in the amount necessary for the provision of social payments are transferred to the account on which, in accordance with the budget legislation of the Russian Federation, transactions with funds received at the temporary disposal of recipients of budget funds are accounted for. Of the Russian Federation (local budget), with the reflection of these operations on personal accounts opened to public authorities of the constituent entity of the Russian Federation (local governments) as recipients of budgetary funds in the territorial body of the Federal Treasury or the financial body of the constituent entity of the Russian Federation (financial body of the municipal formation).

The transfer of funds from personal accounts intended for accounting for transactions with funds received at the temporary disposal of recipients of funds from the budget of the constituent entity of the Russian Federation (local budget) is carried out on the basis of the bodies submitted to the territorial body of the Federal Treasury or the financial body of the constituent entity of the Russian Federation (financial body of the municipal formation) the state authorities of the constituent entity of the Russian Federation (local government bodies) approved by the said bodies lists of recipients of social payments with an indication of the amount of social payments for each recipient.

16. The distribution of subsidies allocated from the budget of the constituent entity of the Russian Federation, including at the expense of the federal budget, between the municipalities participating in the implementation of the subprogram is carried out according to the methodology approved by the act of the constituent entity of the Russian Federation, taking into account the provisions of the budgetary legislation of the Russian Federation.

17. Transfer of funds allocated for the co-financing of the activities of the subprogram to local budgets is carried out from the budget of the constituent entity of the Russian Federation in accordance with the established procedure.

18. The supreme executive body of the constituent entity of the Russian Federation quarterly, by the 20th day of the month following the reporting quarter, submits to the Ministry of Construction and Housing and Utilities of the Russian Federation in the forms established by the Ministry of Construction and Housing and Utilities of the Russian Federation:

a) a report on the use of funds from the federal budget, the budget of the constituent entity of the Russian Federation and local budgets allocated for the provision of social payments as part of the implementation of the subprogram, regional and municipal programs to provide housing for young families;

b) a report on the achievement of the values ​​of the performance indicators for the use of subsidies provided for by the agreement.

19. In the event of failure to submit the reports specified in clause 18 of these Rules, the transfer of funds from the federal budget to the budget of the constituent entity of the Russian Federation for the provision of social benefits shall be suspended until the submission of these reports.

20. The achievement of the value of the performance indicator for the use of subsidies is determined by the Ministry of Construction and Housing and Utilities of the Russian Federation at the end of the financial year based on a comparison of the actual and planned values ​​of the indicator, which is the number of young families who received certificates of the right to receive social benefits.

21. If, as of December 31 of the year of granting a subsidy by a constituent entity of the Russian Federation, the value of the performance indicator for the use of the subsidy established by paragraph 20 of these Rules has not been achieved, and in the period before the first date of submission of reports on the achievement of the performance indicator for the use of the subsidy in accordance with the agreement in the year following the year of granting the subsidy, these violations have not been eliminated, the amount of funds calculated in accordance with paragraphs 16-18 of the Rules for the formation, provision and distribution of subsidies from the federal budget to the budgets of the constituent entities of the Russian Federation, approved by the Government of the Russian Federation dated September 30, 2014 No. 999 "On the formation, provision and distribution of subsidies from the federal budget to the budgets of the constituent entities of the Russian Federation", shall be returned from the budget of the constituent entity of the Russian Federation to the federal budget by June 1 of the year following the year subsidies.

22. The remainder of subsidies not used in the current financial year is subject to transfer to the federal budget in the manner prescribed by the budgetary legislation of the Russian Federation.

If the unused balance of subsidies is not transferred to the federal budget, this balance is subject to collection in the federal budget in accordance with the procedure established by the budget legislation of the Russian Federation.

23. A subsidy in the event of its misuse and (or) violation by a constituent entity of the Russian Federation of the conditions for its provision is subject to collection in the federal budget in accordance with the budgetary legislation of the Russian Federation.

24. Control over compliance by a constituent entity of the Russian Federation with the conditions for granting subsidies is carried out by the Ministry of Construction and Housing and Utilities of the Russian Federation and the federal executive body exercising control and supervision functions in the financial and budgetary sphere.
